WinwayStatsUser Agreement
1. Parties and Service Provider Information
This User Agreement ("Agreement") is concluded between Winway Veri Analizi ve Yazılım Danışmanlık Hizmetleri Limited Şirketi ("WinwayStats"), owner of the WinwayStats mobile application, its web version and the winwaystats.com website (together the "Application"), and the natural person who registers with the Application ("User"), when the User accepts the Agreement electronically during registration.

2. Definitions
• Coin: The virtual unit used to create coupons in the Application, credited to the account as 50,000 on the 1st of each month. It is not money or a right with monetary value.
• Points: The virtual measure calculated from coupon results that determines the ranking.
• Coupon: A virtual prediction record made up of match outcomes the User selects using coins.
• Pisagol: Sample predictions shared in the Application by WinwayStats's statistical model.
• Package (Winway Plus): A paid membership giving access to additional analysis tools for a set period.
3. Nature of the Service
The Application is a behavioural awareness platform offering football statistics, predictions with virtual coins, rankings and analysis tools that let the User see their own decision behaviour.
No real-money betting, games of chance or gambling take place in the Application; no money is deposited and no money is won. Coins and points cannot be converted into money, goods or any other value.
Odds shown in the Application come from independent data providers and are used only to calculate virtual points. WinwayStats is not a representative or partner of any betting company and does not direct the User to any betting site.
Statistics, odds and predictions (including Pisagol) are for information only; they are not betting, investment or financial advice, and their accuracy is not guaranteed. The User is solely responsible for any actions they take outside the Application based on this information.
The Application does not provide psychological, medical or therapeutic services, does not diagnose and does not make decisions on the User's behalf. If the User feels in difficulty, they can contact the support organisations shown in the Application.
4. Membership and Account Security
• You must be at least 18 years old to register. The User confirms that the information provided at registration is accurate and up to date.
• Each person may open only one account. The account is personal; it cannot be transferred, sold or used by anyone else.
• The User is responsible for keeping their password confidential. A User who notices unauthorised use of their account reports it without delay to info@winway.com.tr.
• Usernames may not infringe the rights of others or contain insults, hate speech, obscenity or advertising. WinwayStats may change such usernames after notifying the User.
5. User Obligations
The User agrees:
• To use the Application in accordance with applicable law and this Agreement,
• Not to use other users' accounts, not to open more than one account, and not to cooperate with other accounts to influence rankings or points,
• Not to use bots, automated software or scraping tools; not to attempt to decompile or copy the Application or bypass its security measures,
• Not to reproduce or publish data and content from the Application for commercial purposes without permission,
• Not to exploit any error they notice in the Application (odds, results, balance, etc.) and to report it to WinwayStats,
• Not to attempt anything that would harm the Application or other users.
6. Virtual Coins and Points
Coins and points are entirely virtual and have no real-money value. They cannot be bought, sold, transferred, converted into money or inherited, and they do not constitute an asset owned by the User; they only allow use within the Application.
A confirmed coupon cannot be changed or deleted, and coupon history cannot be hidden. This rule is part of the Application's behavioural awareness purpose.
In the event of a technical error, a data provider error or a later correction of a result, WinwayStats may re-settle the affected coupons according to official results and correct coins and points accordingly.
7. Match Data and Settlement
Match, odds and statistics data come from third-party data providers; delays, omissions or errors may occur.
Coupons are settled according to the official results reported by the data provider and the principles explained in the Rules section of the Application. If a match is postponed or cancelled, or the data needed for settlement cannot be obtained, the selection concerned is refunded.
8. Rankings and Rewards
Rankings are determined solely by points and reset on the 1st of each month.
No rewards are given in this version of the Application. If WinwayStats launches a reward programme in the future, the type of rewards, eligibility conditions and delivery terms will be announced in separate reward terms before the programme starts. Rewards cannot be bought with money or exchanged for cash; paid packages give no advantage in winning rewards.
Points and rankings obtained through cheating, multiple accounts or conduct contrary to this Agreement may be declared invalid.
9. Paid Packages
The content, duration and price including taxes of each package are shown in the Application before purchase. Packages only provide additional analysis tools and a loyalty badge; they give no advantage in coins, points, rankings or rewards.
Purchases are made through an app store (Google Play, App Store) or a licensed payment institution contracted by WinwayStats; card details never reach WinwayStats. For purchases made through an app store, payment, refund and cancellation are also subject to that store's rules.
Packages are services performed instantly in electronic form. Under Article 15(1)(ğ) of the Turkish Distance Contracts Regulation, the right of withdrawal cannot be exercised for such services once performance has started with the User's approval. The User is informed of this and their approval is obtained before purchase.
When packages are sold, the preliminary information form and distance sales contract are presented separately at the purchase step.
The free trial offered to new members may be used only once per person.
10. Notifications and Communication
WinwayStats sends mandatory information about the account, security and the service by e-mail or within the Application.
Phone notifications are off by default; they are sent only for topics the User turns on and can be turned off at any time. No commercial electronic messages (advertising, campaigns) are sent without the User's separate consent.
11. Changes to and Interruptions of the Service
WinwayStats may improve, change or remove features of the Application. Interruptions due to maintenance, updates, data providers or infrastructure may occur; uninterrupted and error-free operation is not guaranteed.
If a feature included in a paid package is removed while the package is active, the User's statutory rights are reserved.
12. Limitation of Liability
WinwayStats is not liable for errors and delays caused by data providers, for decisions the User makes or actions the User takes outside the Application, or for damage arising from the User's device, internet connection or failure to protect their account details.
This limitation does not apply to damage caused by WinwayStats's intent or gross negligence, or to liability that cannot be limited by law.
13. Intellectual Property
The software, design, texts, data compilations, Pisagol model, logo and the name "WinwayStats" belong to WinwayStats or its licensors. The User is granted only the right to use the Application for personal, non-commercial purposes.
Team, league and club names and logos belong to their respective owners and are shown in the Application only to identify matches.
14. Account Deletion, Suspension and Termination
The User may delete their account at any time in the Application or on winwaystats.com. After a deletion request the account waits 30 days; logging in during this period cancels the request. Details are in the Privacy Policy.
If the User breaches this Agreement, WinwayStats may, depending on the seriousness of the breach, warn the User, invalidate the coupons and points concerned, suspend the account temporarily or close it. The User is notified with the reasons and may object at info@winway.com.tr.
15. Personal Data
The User's personal data is processed in accordance with Turkish Personal Data Protection Law No. 6698 as described in the Privacy Policy and the KVKK Information Notice.
16. Changes to the Agreement
WinwayStats may update this Agreement due to changes in legislation or in the service. Material changes to the User's detriment are notified in the Application or by e-mail at least 15 days before they take effect.
A User who does not accept a change may end the Agreement by deleting their account; if they have a paid package, their statutory rights for the remaining period are reserved. The current text and its update date are published in the Application and on winwaystats.com.
17. Governing Law and Dispute Resolution
This Agreement is governed by Turkish law.
Users acting as consumers may apply to the Consumer Arbitration Committee at their place of residence or where the transaction was made, within the monetary limits set annually by the Turkish Ministry of Trade, and to the Consumer Courts for disputes above these limits.
For disputes with Users who are not consumers, the Courts and Enforcement Offices of Denizli have jurisdiction.
18. Evidence and Entry into Force
In disputes, WinwayStats's electronic records (server, coupon and transaction records) may be used as evidence, subject to proof to the contrary.
The Agreement enters into force when the User accepts it electronically during registration and remains valid until the account is deleted. The User can always access the current Agreement in the Settings section of the Application and on winwaystats.com.
